This document shows our standard Terms and Conditions for rental of Villa Tasha to Guests.
This web-site is owned and operated by Villa Tasha, Anguilla represented by the owner, Jeet Mahal, hereinafter referred to as the Owner.
The Owner offers Villa Tasha, hereinafter referred to as the Property, for short term rental to the person making this online booking, hereinafter referred to as the Guest, under the terms and conditions set out below.
The Guest is responsible for all members of his party and shall ensure that they abide by all of the terms and conditions in this document.
The Guest can obtain a written quotation on this web-site by email and/or printer showing the rental fees for the Property. The Guest may then make an online booking for the dates of his choosing by paying a 30% deposit using a credit card. The deposit is calculated as a percentage of the villa rental price and does not take account of the 12% government tax and cleaning fee. As soon as the online booking is made the web-site automatically sends a confirmation email to the Guest and reserves the villa for the dates specified by the Guest. The confirmation email contains the arrival and departure dates chosen by the Guest, hereinafter referred to as the Arrival Date and the Departure Date.
The Owner later sends an email invoice to the Guest for the balance, which is the total rental fee less the 30% deposit paid online by the Guest. The balance is due 60 days before the Arrival Date, or immediately if the booking is made less than 60 days in advance. After receipt of the email invoice the Guest pays the invoice, either by the due date or within 2 business days if the booking is made less than 60 days in advance. The invoice can be paid online on this web-site or by wire transfer provided the booking is made at least 30 days in advance of arrival. If the payment is made by wire transfer the Guest must reply to the email invoice, attaching a copy of proof of payment (a scan, a photo, a PDF file or a screen-shot of the payment instructions to his bank). When the Guest makes payment or provides satisfactory proof of payment by the due date, the Owner sends an email confirming payment and permanent reservation of the villa for the booking dates. For payment by credit card the confirmation of the booking is immediate. For payment by wire transfer confirmation of the booking is immediate but conditional upon receipt of funds.
If the owner has not received payment or proof of payment by the due date (or within 2 business days as described above) then the owner informs the Guest. If payment is not forthcoming the booking is cancelled on the next business day and the deposit is not refunded.
If the guest decides to cancel the booking after paying the 30% deposit, the following cancellation conditions apply:
- for cancellation within 2 business days of making a deposit, the 30% deposit is refunded less a $250 refund charge.
- for cancellation 90 days or more before the Arrival Date, a 5% penalty applies and the Guest will be refunded half the deposit less a $250 refund charge.
- for cancellation less than 90 days before the Arrival Date the 30% deposit is not refunded.
Payment of Invoice and changes to the booking dates
Payment of the invoice for the balance is due 60 days before the Arrival Date or within 2 business days if the booking is made less than 60 days in advance. After payment of the balance the booking cannot be canceled. The guest may request changes to the booking dates at any time, subject to villa availability, by contacting the owner in advance. For minor flight changes or other travel difficulties contact the owner at least 24 hours in advance by email or by using the web-site contact form. For other major changes to the booking dates please contact the owner 60 days in advance. There are no charges for date changes provided the rental rate is not affected by changing to a different rental period.
Before paying the 30% deposit online, the Guest ticked a check-box stating that he had read these terms and conditions. The Guest agrees that payment of the deposit signifies full acceptance of these Terms and Conditions.
The Rental Period begins on the Arrival Date and ends on the Departure Date shown in the confirmation email. Check-in to the Property is after 5:00 PM on the Arrival Date. Check-out is before 11:00 AM on the Departure Date.
The Guest remains responsible for all loss from the Property or its inventory during the Rental Period. You agree that during your stay at the Property the Owner may debit a $500 security deposit from your credit card. At the end of your stay, after deduction of any damage or loss the balance is re-credited to your credit card.
No Smoking inside the villa
Smoking is permitted outside the villa on the Property grounds but is not permitted inside the villa at any time. In the event that the Guest is found to have smoked inside the villa, the Guest will be liable for any charges related to the cleaning/deodorizing of the Property.
Pets are not permitted on the Property unless the Guest obtains written permission in advance from the Owner.
The Owner makes all reasonable efforts to maintain the Property and its equipment in good working order. Wherever possible, repairs are performed promptly, but sometimes delays are inevitable due to circumstances beyond the control of the Owner. No refunds are granted for malfunctioning mechanical or electrical/electronic equipment.
The Owner does not accept liability for personal loss or damage, nor liability for injury or accidents during the Rental Period. The Guest must ensure that he has adequate insurance coverage. The Guest must ensure that Children are supervised at all times. Children under the age of 16 years are not to be left on the Property un-supervised during the rental period.
In the event of a pending hurricane, all guests MUST vacate the Property when instructed to do so by the Owner, in which case any unused rent and taxes will be refunded. It is the sole responsibility of the guest to secure other accommodation or change airline tickets for an early departure as required.
Illegal drugs and hazardous materials
The Guest and members of his party shall not use or permit to be brought into the villa any illegal substances or articles deemed hazardous to life, limb or property.
The Rental Agreement between the parties shall be governed and construed in accordance with the laws of Anguilla. The parties hereto hereby irrevocably submit to the non-exclusive jurisdiction of the courts of Anguilla. The prevailing party in any litigation shall be entitled to reimbursement of all costs and legal fees incurred in connection with the litigation.
